1.  Introduction & Acceptance

These Terms & Conditions (the “Terms”) govern your use of this website and your engagement with the services provided by Worldwide Property Co., a trading name of Pontcanna Estates FZCO, a company registered in the United Arab Emirates.

Acceptance of Terms: By engaging with our team for the first time — whether by telephone, email, video call, or in person — you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you should not engage our services.

Where a separate written Client Agreement has been entered into (for example, in connection with financing services), that agreement shall take precedence over these Terms in the event of any conflict.

2.  Use of This Website

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the site. You must not:

  • Use this website in any way that is unlawful, fraudulent, or harmful
  • Transmit unsolicited commercial communications or spam
  • Attempt to gain unauthorised access to any part of this website or its underlying systems
  • Scrape, copy, or systematically extract property listings, content, or data from this website without our prior written consent
  • Upload or transmit any material that contains viruses, malware, or any other harmful code

We reserve the right to restrict or terminate access to this website for any user who breaches these Terms, without notice.

3.  Our Services

Worldwide Property Co. provides international property sourcing and financing introduction services. The nature of our role varies depending on the service and the specific opportunity, as set out below.

Property Services

We assist clients in identifying and accessing luxury residential and investment properties across France, Spain, Portugal, and Mauritius. We operate in one of two ways:

  • Direct representative — where we work in direct partnership with a developer, we act as their authorised sales representative and support clients through the purchase process from initial enquiry through to completion.
  • Introducer — where we work alongside third-party estate agents, we act as an introducer, connecting clients with agents who hold listings across the wider market. In these cases, the contractual and transactional relationship is between the client and the relevant agent or developer directly. Worldwide Property Co. is not a party to that transaction.

Clients engaging our property sourcing service are under no obligation to purchase any property through us, and no exclusivity agreement exists unless separately agreed in writing.

Financing Introduction Services

We act solely as an introducer in relation to all financing arrangements. We do not provide mortgage advice, financial advice, or any other regulated financial service. Depending on a client’s circumstances, we may introduce them to:

  • A mortgage adviser — an independently operating professional who will conduct their own assessment and provide regulated mortgage advice. Any advice given is the sole responsibility of that adviser.
  • A private bank — who will engage with the client directly under their own terms, carry out their own due diligence, and provide advice under their own regulatory framework.

Clients seeking financing introductions will be asked to enter into a separate Client Agreement prior to engagement, which sets out the specific terms, scope, and fees applicable to that service.

Professional Network

We maintain a panel of English-speaking professionals across our key markets, including lawyers, notaries, accountants, and surveyors. Where a client requests an introduction to a professional, that introduction is made as a courtesy. Any engagement with a third-party professional is entirely at the client’s discretion, and Worldwide Property Co. accepts no responsibility for the advice or services provided by those professionals.

4.  Fees, Commissions & Disclosure

Worldwide Property Co. operates on a commission basis. In the interest of full transparency, the following applies:

Property Services — No Cost to the Buyer

Our property sourcing service is provided at no direct cost to the buyer. We are remunerated by way of commission, which is paid by the third party to the transaction, as follows:

  • Resale properties — where we introduce a client to a third-party estate agent who holds a listing, we receive a referral fee or a share of the agent’s sales commission upon successful completion of a transaction. This does not affect the purchase price paid by the client.
  • New build and off-plan properties — where we act as a direct sales representative for a developer, we receive a sales commission from the developer upon successful completion. Again, this does not affect the price paid by the client.

The existence of these commercial arrangements does not affect our obligation to act in your best interests in identifying suitable properties. You are not charged any additional amount as a result of working with us.

Specific commission amounts vary by transaction and by partner. If you would like further information about the remuneration arrangement applicable to a specific property or introduction, please ask your advisor and we will be happy to provide details.

Financing Services — Fees Charged to the Client

Our financing introduction service is subject to a fee payable directly by the client. The specific fee, payment terms, and scope of service are set out in the Client Agreement, which will be provided and agreed in writing before any financing introduction is made.

We may also receive a referral fee or introducer commission from the mortgage adviser or private bank to whom we make an introduction. Where this applies, it will be disclosed in the Client Agreement.

No Undisclosed Benefits

We are committed to transparency in our commercial relationships. We do not accept undisclosed payments, gifts, or incentives from any partner in connection with a client introduction.

5.  No Advice & Client Responsibilities

Worldwide Property Co. does not provide, and you should not construe any of our communications as constituting:

  • Financial, mortgage, or investment advice
  • Legal advice
  • Tax advice of any kind, including in relation to purchase taxes, wealth tax, capital gains tax, rental income tax, or inheritance tax in any jurisdiction
  • Structural, survey, or valuation advice

Your responsibilities: You are solely responsible for carrying out your own due diligence before entering into any property transaction or financing arrangement. This includes, but is not limited to:

  • Obtaining independent legal advice from a qualified solicitor or notary in the relevant jurisdiction
  • Obtaining independent financial and mortgage advice from a regulated adviser
  • Obtaining independent tax advice relevant to your personal circumstances and country of residence
  • Commissioning a structural survey or valuation where appropriate
  • Satisfying yourself as to the condition, title, and suitability of any property before exchange or completion

We strongly recommend that all clients engage independent advisers before proceeding. We are happy to introduce you to English-speaking professionals across our key markets.

6.  No Guarantees

We do not make any guarantee, warranty, or representation in relation to the following:

  • Property availability — listings are subject to change, withdrawal, or sale at any time without notice
  • Purchase price — prices are correct at the time of publication but may be subject to change by the developer or agent. Off-plan prices are indicative and subject to contract
  • Mortgage or financing approval — an introduction to a mortgage adviser or private bank does not guarantee that finance will be offered or approved. Lending decisions are made entirely at the discretion of the lender
  • Investment performance — past performance of property markets is not a reliable indicator of future performance. Property values can fall as well as rise, and rental income is not guaranteed
  • Rental yields — any yield figures or rental income estimates provided are indicative only and based on market information available at the time. Actual returns will vary
  • Exchange rates — all property prices are displayed in the currency indicated. Exchange rate movements may materially affect the cost of a purchase for buyers transacting in a different currency
  • Completion timescales — particularly in relation to new build and off-plan developments, completion dates are estimates and may be subject to change

7.  Third-Party Services

We work with a network of third-party professionals, agents, developers, and service providers. The following applies to all such third-party relationships:

  • Third parties operate independently of Worldwide Property Co. and are solely responsible for their own services, conduct, advice, and regulatory compliance
  • Any contract, agreement, or transaction entered into with a third party is solely between you and that third party. Worldwide Property Co. is not a party to, and accepts no responsibility for, any such arrangement
  • We do not endorse, guarantee, or accept liability for the quality, suitability, accuracy, or outcome of any service or advice provided by a third party
  • Third parties may have their own terms and conditions, privacy policies, and fee structures which will apply independently to your engagement with them

We encourage all clients to review the terms and credentials of any third party before entering into a formal engagement or financial commitment.

8.  Investment Risk

Property investment carries inherent risks. By engaging our services, you acknowledge and accept that:

  • The value of property can decrease as well as increase, and you may receive less than you invest
  • Rental income, where applicable, is not guaranteed and may be affected by market conditions, occupancy rates, management costs, and regulatory changes
  • Currency risk — where a property is purchased in a foreign currency, exchange rate movements may affect the value of your investment when measured in your home currency
  • Liquidity risk — property is not a liquid asset and may take a significant period of time to sell
  • Regulatory and tax risk — laws governing property ownership, taxation, and rental activity may change in any of the jurisdictions in which we operate
  • Development risk — for off-plan purchases, there is a risk that the development may be delayed, amended, or in exceptional circumstances not completed

You should only proceed with a property investment if you fully understand these risks and have taken appropriate independent advice.

9.  Limitation of Liability

To the fullest extent permitted by applicable law, Worldwide Property Co. (including its directors, employees, agents, and partners) excludes all liability for:

  • Any direct, indirect, consequential, incidental, or special loss or damage arising from your use of our services or this website
  • Any loss of profit, revenue, business, savings, data, goodwill, or anticipated savings
  • Any decisions made or actions taken in reliance on information, introductions, or communications provided by Worldwide Property Co. or its representatives
  • The acts, omissions, advice, or conduct of any third party — including estate agents, developers, mortgage advisers, private banks, lawyers, notaries, accountants, or surveyors — to whom we have made an introduction
  • Any failure of a property transaction to proceed to completion, for whatever reason
  • Any failure of a financing application or any lending decision made by a third party
  • Any loss arising from currency fluctuations, market movements, or changes in law or regulation

Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be lawfully excluded or limited, including mandatory consumer protection rights applicable under the laws of your country of residence.

10.  Communications

All written and verbal communications from Worldwide Property Co. — including emails, call notes, presentations, property brochures, market updates, and website content — are provided for general informational purposes only.

Nothing in our communications constitutes a binding offer, a guarantee, or advice of any kind. Property details shared during the course of an engagement are subject to change and should be verified independently before any reliance is placed upon them.

We may communicate with you by email, telephone, video call, or messaging platforms. By engaging our services, you consent to being contacted by these means in connection with your enquiry or ongoing matter.

11.  Privacy & Data Protection

Your privacy is important to us. The collection, use, and storage of your personal data in connection with our services is governed by our Privacy Policy, which is available at worldwideproperty.co and forms part of these Terms.

By engaging our services, you confirm that you have read and understood our Privacy Policy and consent to the processing of your personal data as described therein.

12.  Intellectual Property

All content on this website and in our marketing materials — including text, articles, destination guides, property listings, images, logos, branding, and the design and layout of this website — is the property of Worldwide Property Co. or is used with the permission of the relevant rights holder.

You may view, download, and print content for your own personal, non-commercial use only. You may not:

  • Reproduce, republish, or distribute any content without our prior written consent
  • Use our content, listings, or data for commercial purposes or in connection with a competing business
  • Remove or alter any copyright or proprietary notices
  • Scrape or systematically extract data or listings from this website

The Worldwide Property Co. name, logo, and brand are the property of Pontcanna Estates FZCO. Unauthorised use is strictly prohibited.

13.  Amendments to These Terms

We reserve the right to update or amend these Terms at any time. The date at the top of this page indicates when these Terms were last reviewed. Continued engagement with our services following any update constitutes acceptance of the revised Terms.

We recommend reviewing these Terms periodically. Where changes are material, we will take reasonable steps to bring them to your attention.

14.  Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of the United Arab Emirates.

Consumer rights: If you are a consumer resident in the United Kingdom or a member state of the European Union, you may have additional rights under the mandatory consumer protection laws of your country of residence. Nothing in these Terms is intended to exclude or limit those rights.

If you have a complaint or concern, we encourage you to contact us in the first instance so that we can seek to resolve the matter promptly and directly.
